Car Safety Law For Children

When placing your child in a car you should be aware of the laws surrounding child car seats and traditional belts as there are differing regulations for different children and vehicles. In each of these cases it is the duty of the person driving to ensure children are restrained in the correct way.
Young infants
If your baby is in the seat next to the driver and an airbag is present, it is prohibited for you to use a backwards facing baby carrier. If the airbag was to release greater damage would be caused if the wrong restraint was used.
Children up to three
Need to be correctly restrained in all seats of a car, back or front. There is only one exception and that is in a licensed taxi or licensed hire vehicle where the necessary child seats are unavailable. In this scenario a child of this age can travel in the back unrestrained. However, you need to make sure that the compulsory child seating is available as this was brought in for practical reasons not safety.
Children under 1.35 metres high or between three and twelve years old
In 2006, regulations were introduced to ensure seatbelts were situated properly across a child’s body. It is mandatory for small youth to sit in a specific removeable car seat for safety. This law applies to children up to the age of twelve or 1.35 metres tall, whichever comes first.
There are exceptions to this rule where a child in this section can wear an adult seatbelt alternatively. If three child seats will not fit in the back of the vehicle and two are in use, then the third youth is permitted to wear an adult belt. For a short distance in an crisis situation a child can wear an adult belt. In a private rental vehicle or authorized taxi this is also permitted.
If seat belts are not on hand in the rear of a vehicle then a youngster older than three is allowed by law to travel without restraint.
Youth older than twelve or talller than 1.35 metres
In both the front and back of any vehicle a child must wear an adult seatbelt if available.
Passengers fourteen and older must wear a seatbelt if provided in buses, coaches and minibuses.
Other
Non UK citizens must also conform to the same regulations and carry the necessary child restraint. If you are leasing a car then the company should be able to stock the essential car seats if they are informed prior to collection.
Your child’s safety should be of the extreme importance, it is your obligation to make sure your child is restrained properly. When travelling in someone else’s vehicle you should make sure that the car is accordingly equipped with the applicable child seat.
